How the Texas notary fees calculation works

What a Texas notary may charge under Government Code §406.024: $10 for the first signature on an acknowledgment and $1 for each additional signature, $10 for an oath, the other set fees, and the online notarization fee.

  1. Acknowledgments: $10, then $1

Taking an acknowledgment, including the certificate and seal, is up to $10 for the first signature and $1 for each additional signature. Three signatures is up to $12.

  2. Oaths and other certificates: $10

Administering an oath or affirmation with certificate and seal is up to $10, as is a certificate under seal not otherwise provided for.

  3. Online notarization: up to $25 more

An online notary may charge up to $25 for an online notarization, on top of the other fees allowed by §406.024.

  4. Don't overcharge

The Secretary of State warns that charging more than the maximum can lead to criminal prosecution and suspension or revocation of the commission.

Worked example. A Texas notary taking an acknowledgment with three signatures may charge up to $12: $10 for the first signature and $1 each for the other two.
